Karnataka RERA: List of Approved Projects, Agents and All about it

The Karnataka government has notified the detailed set of rules for Real Estate Regulation and Development Act (RERA) on 10thJuly 2017.

Also, a list of ongoing projects; that have been applied by respective builders or authorities for registration certificate under the Real Estate Regulation and Development Act (RERA), has been uploaded by the Karnataka Real Estate Regulatory Authority or Karnataka RERA on its website.

One can access the Karnataka RERA website and see the list of approved projects so far. At the time of writing this article, the total number of such projects was 1466.

Please not that, this list of approved projects gets updated, in terms of addition and deletion of projects from list, on every Friday at 1 PM based on the response or reply received from the Project Developers or builders against the notices issues by the Karnataka RERA.

A very clear warning message/notification stating “Public is hereby informed that these projects are not registered with RERA and are under INVESTIGATION. The public is warned that dealing with these projects is at their own risk as these are not registered with RERA” has been put on the Karnataka RERA website page for ‘Projects under investigation’ in bold “.

It has also been informed by the officials that, notices to the builders / developers of these projects have been already dispatched as a final warning. The builders have a maximum of three weeks to comply, failing which there is a penalty of 10 percent of the project cost, which will be imposed on the developers.

Total number application received in Karnataka RERA for registration of real estate agents till date (April 4, 2018) is 1035.

The total number of real estate agents registered under the list of approved real estate agents in Karnataka RERA has reached 841, as on April 4, 2018.

Applications of 2,062 real estate projects have been filed to the portal of Karnata RERA, as on April 4, 2018 for approval. Of these applications received,

  • 1,466 real estate projects have been approved by Karnataka RERA
  • 52 Applications have been rejected by Karnataka RERA
  • 194 applications in the query
  • 350 applications in the process

RERA for Buyers

  • The enforcement of these rules will ensure that the State’s citizens can now get information and choose suitable apartments/houses/plots without having to worry about the project execution and with a recourse to complaints and suitable action against defaulting developers/agents.
  • Buyers will have a real-time view/update on the project status, litigations against any promoters etc.
  • This Act now gives consumers within the state a platform to voice their grievances and lodge complaints against a promoter/agent.
  • The advertisement or prospectus issued or published by the promoter shall mention prominently the website address of Karnataka RERA wherein all details of the registered project have been entered and include the registration number obtained from the Authority


Filing of Complaint in Karnataka RERA:

Any aggrieved person may file a complaint with the Regulatory Authority for any violation of the Act or the rules and regulations. Aggrieved Consumer would file the complaint with the Adjudicating Officer. He would have to provide a fee of INR 1,000 in form of DD. The consumers can file their complaint with Regulatory Authority or Be Adjudicating Officer.

Fee for filing a complaint in Karnataka RERA

Any aggrieved person may file a complaint with the Karnataka RERA for any violation under the Act by filling up “Form N”.

The fee for filing complain is Rs. 1000, which can be paid by a demand draft drawn on a nationalized bank or a co-operative Bank in favor of regulatory authority and payable at the main branch of that bank at the station where the seat of the said Regulatory Authority is situated.

Fee for filing a complaint with the Adjudicating Officer

Any aggrieved person may file a complaint with the Adjudicating Officer for any violation of the Act by filling up “Form O”.

For this a fee of Rs. 1000 has to be paid. The fee can be paid by using a demand draft drawn on a nationalized bank or a Co-operative Bank in favor of regulatory authority and payable at the main branch of that bank at the station where the seat of the said Regulatory Authority is situated.

Fee for filing an appeal with the Appellate Tribunal

An appeal can be filed with the Appellate Tribunal by filling “Form R” in triplicate along with a fee of Rs. 5000.

The fee can be paid using demand draft or a bankers cheque drawn on a scheduled bank or a co-operative bank in favour of the Appellate Tribunal and payable at the branch of that Bank at the station where the seat of the said Appellate Tribunal is situated or through online payment.

Note – The information available above is as per the RERA notification by the Karnataka government. The fee for registration of real estate projects and agents may vary from state to state.

Karnataka RERA for Developers:

Project Registration fee for real estate developers in Karnataka RERA

To conduct the real estate business in Karnataka, a real estate developer has to pay a registration fee at the time of filing application for registration of his project with the Karnataka RERA authority.

The real estate developer can pay the registration fee using demand draft or a bankers cheque drawn on any scheduled bank or a Co-operative Bank or through online payment mode.

Group housing project registration fee

  • Rs 5 per square meter – In case the area of land proposed to be developed do not exceed 1000 square meters.
  • Rs 10 per square meter – (capped up to Rs. 5 lakhs) – For projects where the area of land proposed to be developed exceeds 1000 square meters.

For mixed development (residential and commercial) project

  • Rs 10 per square meter – For projects where the area of land proposed to be developed do not exceed 1000 meters.
  • Rs 15 per square meter (capped up to Rs. 7 lakhs) – For projects where the area of land proposed to be developed exceeds 1000 square meters

In case of commercial projects

  • Rs 20 per square meter – For projects where the area of land proposed to be developed does not exceed 1000 square meters
  • Rs 25 per square meter (capped up to Rs. 10 lakhs) – For projects where the area of land proposed to be developed exceeds one thousand square meters.

In case of plotted development projects

  • Rs 5 per square meter, but capped to Rs. 2 lakhs

Fee for application for the time extension of Real Estate Project

A developer can apply for the time extension for the completion of his real estate project. To do so, the developer can file an application by filling up “Form E”.

The developer also has to pay an amount equivalent to half the registration fees as prescribed under sub-rule (3) of rule 3 along with an explanatory note setting out the reasons for the delay in the completion of the project.

The real estate developer can pay the registration fee using demand draft or a bankers cheque drawn on any scheduled bank or a Co-operative Bank or through online payment mode.

Fee for withdrawing the application for registration of the project

If a real estate developer can apply for withdrawal of his/her project application filed for registration of the project before the expiry of the period of thirty days specified under sub-section (1) of section 5.

For withdrawing application, a processing fee to the extent of 10% or Rs. 50,000 whichever is more, will be deducted from the project registration fee paid by the developer and the remaining amount will be refunded to the applicant within thirty days from the date of such withdrawal.

 

Penalty For developers

  1. If any promoter contravenes the provisions of section 3, he will be liable to a penalty which may extend up to 10% of the estimated cost of the real estate project as determined by the Authority.
  2. If any promoter does not comply with the orders, decisions or directions issued under sub-section (1) or continues to violate the provisions of section 3, he will be punishable with imprisonment for a term which may extend up to three years or with fine which may extend up to a further 10% of the estimated cost of the real estate project, or with both.

Karnataka RERA for Agents

Penalty for agents

According to section 62 states, if any real estate agent fails to comply with or contravenes the provisions of section 9 or section 10, he will be liable to a penalty of Rs. 10,000 for every day during which such default continues, which may cumulatively extend up to 5% of the cost of plot, apartment or buildings, as the case may be, of the real estate project, for which the sale or purchase has been facilitated as determined by the Authority.

Real Estate Agent Registration fee

To get registered under Karnataka RERA, a real estate agent has to pay a registration fee at the time of application.

The registration fee can be paid by demand draft or a bankers cheque drawn on any scheduled bank or a co-operative bank or through online payment.

For an individual, the application fee for registration as an agent in Karnataka Rera is Rs 25000.

In case the applicant wants to get registered as firm, agency or any other category other than an individual, the application fee will be Rs 2,000,00.

Fee for the renewal of the registration of real estate agent/s

For renewal of their registration in Karnataka RERA, the real estate agent will need to file by submitting an application for renewal of registration “Form J”

The applicant has to pay a sum of Rs 5000 in case of the being an individual or sum of Rs 25000 in cases the applicant other than an individual as a renewal fee.

The renewal fee can be paid in form of demand draft or a bankers cheque drawn on any scheduled Bank or a co-operative Bank or through online payment to the authority.
